Who May Exhibit

The Michigan Lumber and Building Materials Association owes a fiduciary obligation to its members to take any reasonable and necessary action to protect the association's proprietary rights and its assets from damages resulting from infringement or usurpation by way of (including but not limited to) exploitation through association membership, advertising in association publications, or exhibiting at the association sponsored events or trade shows. Therefore, to enforce its rights under this policy, the Michigan Lumber and Building Materials Association may deny the right to exhibit in or provide sponsorship in any association produced event or trade show to anyone where the Board of Directors of the Association has reason to believe such action would be in the best interest of the association in furtherance of the provisions of the policy.

Deposit and  Payment Schedule
If a 2009 exhibit space is not paid in full by September 26, 2008, the deposit will be returned to the exhibitor and the booth space made available to others. A cancellation charge of 5% of the booth fee will be assessed if written cancellation occurs before September 26, 2008. A cancellation charge of 25% of the booth fee will be assessed if written cancellation occurs between September 26, 2008 and December 1, 2008. A cancellation charge of 50% of the booth fee will be assessed if written cancellation occurs after December 1, 2008. Cancellations made less than seven days prior to the move-in date or no-shows will not receive a refund.

Members in Good Standing

Companies purchasing/occupying booths at the MLBMA member price must be current MLBMA member in good standing. If an exhibitor's Associate or Affiliate Member status lapses before the 2009 Expo is held, MLBMA reserves the right to charge the member/non-member booth price differential prior to the exhibitor move-in.


Liability

The Michigan Lumber and Building Materials Association shall not be responsible for any loss, damage, or injury that may occur to the exhibitor or to the exhibitor's employees or property from any cause whatsoever, prior, during, or subsequent to the period covered by the exhibit contract, and the exhibitor, on signing of the contract, or submitting an on-line booth request form expressly releases MLBMA from and agrees to indemnify same against all claims for such loss, damage, or injury. The exhibitor causing same must pay for any damage to Soaring Eagle Casino & Resort (SECR) due to carelessness of the exhibitor or his employees. The exhibitor assumes the entire responsibility and liability for losses, damages, and claims arising out of injury or damage to exhibitor's displays, equipment, and other property brought upon the premises of  the Soaring Eagle Casino & Resort (SECR) and shall indemnify and hold harmless the Soaring Eagle Casino & Resort (SECR) agents, servants, and employees from any and all such losses, damages, and claims. The exhibitor will abide by all rules and regulations, whether existing or established, by MLBMA.

Booth placement for the Great Lakes Building Products Exposition will be determined in two phases by a Point System. During the first phase, completed applications received by August 31st with a 50% deposit will be placed/assigned according to the booth request and by the number of points earned by each company. In the second phase, any applications received after September 1st are placed on a first-come, first-served basis. If, during that time period, two applications requesting the same booth space are received on the same date, the point system will be used to determine placement.

How the Exhibitor Point System Works


Each company is awarded points in several categories
:

  • Number of Great Lakes Building Products Expositions since 2000 in which a company exhibited (one point per year).
  • Total number of booths the company purchased since 2000 (one point per 10' x 10' space).
  • Number of years since 2000 the company has been an MLBMA member in good standing (10 points allotted per year).
  • One percent of total sponsorship dollars spent on the 2008 Expo (dollar amount assigned in points).
  • One percent of total advertising dollars spent on E-ssential Framework in 2007/2008 (dollar amount assigned in points).
    One percent of total advertising dollars spent in the 2007/2008 MLBMA Membership Directory (dollar amount assigned in points).
  • One percent of total sponsorship dollars spent on the 2007 MLBMA Golf Outing (dollar amount assigned in points).

The points in each of these categories will be added together. In the event that two or more companies with equal points request the same space, the date the application was received by MLBMA will be the deciding factor. If two companies merge, the new entity will be awarded the higher of the individual company's points for each year. The new entity can only receive a maximum of 10 points per year for membership.


Exhibit Booth Information
Height: Exhibit fixtures, components, and identification signs will be permitted to a maximum height of 8'.  Depth: Exhibit fixtures, components and identification signs will be permitted along either side to a maximum height of 8" high, no more than 3'-6" from the rear wall forward.  The remaining area of either side may not be higher than 3"-6".

Exhibit Booth Furnishings and Freight Handling
Print and complete the Art Craft order form and fax to Art Craft on or before December 28, 2008 to receive pre-show discount. Orders received by Art Craft after December 28, 2008 or at the Expo will pay full price.

Electrical Services/Internet Orders/Telephone Lines
Print and complete the application and return to the Michigan Lumber and Building Materials Association on or before

Access to Show Floor Policy

In an effort to protect the integrity of the Great Lakes Building Products Exposition and to ensure the value of exhibit space at the Expo for companies paying to exhibit, the policy for non-exhibiting suppliers wanting to-access the show floor/visit the trade show/walk through/preview the show for next year, etc., is as follows:

Any non-exhibiting supplier who wishes to attend the trade show at the Expo shall be charged $670 per company (MLBMA member) or $930 per company (non-member) for one representative to enter the hall. Each additional representative will be charged $50.

If that non-exhibiting supplier purchases a booth in next year's Expo, 90% of their trade show registration fee from this year's Expo will be applied toward that booth cost.

The only exception to this policy will be for a non- exhibiting supplier who directly provides sponsorship for the current year Expo at a level of $1500 or higher. Up to two-exhibit hall passes will be provided for that sponsorship. The "No Tolerance Policy" (below) will still apply.


No Tolerance Policy

The Great Lakes Building Products Exposition has a "no tolerance" policy regarding "suit casing," which is the practice by non-exhibiting companies or individuals (who paid to walk the show floor or gained entry due to sponsorship as indicated above) of distributing business cards, soliciting sales or sales leads, representing their services, or soliciting Expo attendees to attend conflicting activities while on the trade show floor or in Association-related functions.

Non-exhibiting suppliers participating in Expo events are prohibited from soliciting business on the trade show floor and/or before, during or after educational or networking events. Violators of this policy will be removed from the Expo and charged a full exhibit booth rate which must be paid prior to registering as an attendee, exhibitor, or sponsor at any future Expo.

All or any part of the space hereinabove designated is subject to reassignment and rearrangement by MLBMA for the purpose of consolidation of display space for any reason. The judgment of MLBMA with respect to such reassignment or rearrangement of space shall be final. The total square footage occupied by exhibitor shall not be reduced or increased substantially without the consent of exhibitor, and if so reduced or increased the amount of rental payable shall be appropriately adjusted.

MLBMA cannot guarantee that companies exhibiting similar products or a competitor will not be located in a nearby or adjoining booth space.

Exhibitors exceeding height and depth limitations will be asked to remove the obstruction.

Contracted or leased escorts, adult entertainment industry models, persons wearing bathing suits and/or less than normal business/casual attire etc. are prohibited from working in booths or walking the show floor as advertisements or representatives. This violation will result in the model(s) and exhibiting company being immediately removed from the exposition.


Indemnity


Any loss, damage or injury, which may occur to any person or property as a result of any negligent act by the exhibitor, its representatives, agents or employees, shall be the responsibility of the Exhibitor. Exhibitor shall indemnify and hold harmless MLBMA and the Soaring Eagle Casino & Resort (SECR)  from any and all claims made as a result of Exhibitor's negligent acts.
Neither MLBMA or the Soaring Eagle Casino & Resort (SECR) shall be responsible for any loss, damage or injury which may occur to Exhibitor, its property, or its representatives, agents or employees unless such loss, damage or injury is caused by the negligent acts of MLBMA or the Soaring Eagle Casino & Resort (SECR).

MLBMA hereby reserves the right to eject and remove exhibitor or its exhibit without notice for violation of any of the terms of this agreement without MLBMA being deemed guilty of trespass in any manner whatsoever, in which case the rental specified herein shall be retained by MLBMA as liquidated damages. Exhibitor agrees to such additional rules and regulations, as MLBMA shall deem necessary for proper conduct of the exhibition.


Subletting Space

It is agreed by the parties hereto that the license contracted for by exhibitor is not assignable by exhibitor to any other party without permission from MLBMA

Installing and Removing Exhibits
Exhibitors must have their displays set up and operational by 1:00 p.m. on Thursday, January 15, 2009. Tear down of exhibits before Friday's 5:00 p.m. show closing will result in forfeiture of future exhibit space.

Insurance
All property of the Exhibitor is understood to remain under its custody and control, in transit to or from or within the confines of the Soaring Eagle Casino & Resort (SECR), subject to the rules and regulations of the Exposition.

Applicable Laws

The rights, duties and obligations of the parties, and the validity, interpretation, performance and legal effect of the Agreement shall be governed and determined by the laws of the State of Michigan.

Severability

Any term, clause, or condition which is subsequently adjudged invalid or illegal shall be stricken from the Agreement as never included and all remaining valid and legal conditions, clauses, and terms will thereupon comprise this Agreement.

Modification of Agreement
This agreement may not be amended, nor shall any waiver, change, modification, consent or discharge be effected except by instrument in writing executed by or in behalf of the party against whom enforcement of any such change, modification, consent or discharge is sought. This agreement, which includes, by reference, the 2009 Floor Plans with all the terms appearing thereon, contains the complete understanding between MLBMA and Exhibitor and may not be varied, modified or amended except by written agreement signed by both parties.

Music

No live music performances or uses of recorded music will be permitted unless the exhibitor can demonstrate that it has obtained the requisite copyright licenses from ASCAP, BMI and other appropriate organizations.


Soaring Eagle Casino & Resort Exhibit Hall Regulations

Exhibitor agrees to pay for any labor service, electrical outlets, telephone, internet service or any other services, which may be required and/or ordered in connection with exhibitor's display. If dispensing or serving beverages or food from the booth it must be purchased from the official caterer of the Soaring Eagle Casino & Resort (SECR). No signs or placards should be posted in exhibitor's space or in any other part of Soaring Eagle Casino & Resort (SECR) by means of tacks, tape, nails, or pins to the walls, doors, or woodwork of said Center.  Exhibitors are not allowed to store materials behind their booths. No helium balloons are allowed in the Exhibit Hall.  No semi-trailer trucks and other large, high, solid objects will  be allowed in designated areas of the exhibit hall or concourse.
